Welcome to Arvox. These Terms and Conditions (“Terms”) govern your access to and use of the Arvox website, mobile applications, platform, products, services, and related features, including Web, iOS, Android, Apple Watch, Garmin integrations, and other connected experiences.

These Terms are entered into between you and Arvox S.A.S. (“Arvox,” “we,” “our,” or “us”).

By accessing or using Arvox, you agree to be bound by these Terms. If you do not agree with these Terms, you should not access or use Arvox.

1. About Arvox

Arvox is a performance and training platform designed for athletes, coaches, gyms, clubs, and fitness communities. Arvox helps users create workouts, execute training sessions, track results, monitor progress, manage clubs, and analyze performance data.

Arvox is a fitness and performance technology platform. Arvox is not a medical provider, healthcare service, emergency service, or substitute for professional medical advice.

2. Eligibility

You may use Arvox only if you are legally able to enter into these Terms and comply with all applicable laws.

If you use Arvox on behalf of a gym, club, company, team, or other organization, you represent that you have authority to bind that organization to these Terms.

• You are at least the minimum legal age required in your jurisdiction to use online services.
• You have the legal authority to accept these Terms.
• Your use of Arvox will comply with applicable laws and regulations.
• The information you provide to Arvox is accurate, complete, and up to date.

3. Accounts and Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Arvox is not responsible for losses caused by unauthorized use of your account due to your failure to protect your credentials.

• Provide accurate and complete account information.
• Keep your account information updated.
• Protect your password and authentication credentials.
• Notify us immediately if you suspect unauthorized access to your account.
• Not share your account with another person unless expressly permitted by Arvox.

4. User Roles and Club Access

Arvox may support different user roles, including athletes, coaches, personal trainers, club administrators, branch managers, gym owners, and platform administrators.

Access to specific features may depend on your role, permissions, subscription, club membership, or organization settings.

If you are connected to a club, gym, team, coach, challenge, class, or competition, certain information such as profile details, workout results, attendance, training history, and performance metrics may be visible to authorized users within that environment.

5. Health, Fitness, and Safety Disclaimer

Arvox provides tools for workout tracking, performance analysis, training management, and fitness engagement. Arvox does not provide medical advice, diagnosis, treatment, or healthcare services.

You voluntarily assume all risks related to your use of Arvox and participation in any fitness activity connected to Arvox.

• Physical exercise involves risk of injury, illness, or death.
• You are responsible for determining whether you are physically fit to participate in any workout, training plan, challenge, competition, or fitness activity.
• You should consult a qualified healthcare professional before starting or changing any exercise program.
• Arvox does not guarantee that any workout, score, target, recommendation, challenge, or training plan is safe or appropriate for you.
• Coaches, clubs, and users are responsible for designing, reviewing, scaling, supervising, and executing workouts safely.

6. Training Data and Performance Results

Arvox may allow users to record, upload, sync, calculate, display, or analyze workout and performance data, including scores, times, loads, repetitions, rounds, attempts, calories, heart rate, distance, personal records, benchmarks, attendance, and competition results.

You are responsible for the accuracy of the information you enter or upload. Arvox may display analytics, comparisons, trends, leaderboards, rankings, or other performance insights, but these outputs are provided for informational and motivational purposes only.

Arvox does not guarantee that all data will be accurate, complete, uninterrupted, or error-free.

7. Wearables and Third-Party Integrations

Arvox may integrate with third-party platforms, devices, and services, including Apple Watch, Garmin, Apple Health, Google Fit, app stores, payment processors, analytics tools, or other third-party systems.

Your use of third-party services may be subject to separate terms, privacy policies, permissions, and settings. Arvox is not responsible for the availability, accuracy, security, performance, or policies of third-party services.

8. Subscriptions, Paid Features, and Billing

Arvox may offer free features, paid subscriptions, premium plans, club plans, in-app purchases, or other paid services.

By purchasing a paid service, you agree to pay all applicable fees, taxes, and charges. Pricing, features, billing cycles, renewal terms, and cancellation options may vary depending on the plan, platform, region, promotional offer, or payment provider.

Unless otherwise stated, subscriptions may automatically renew until canceled. You are responsible for canceling your subscription before the renewal date if you do not want to be charged again.

9. Refunds and Cancellations

Refund eligibility may depend on the type of purchase, payment provider, subscription plan, applicable law, and platform used for the transaction.

Unless required by law or expressly stated by Arvox, payments are non-refundable. If you purchased through a third-party app store or payment provider, refund requests may need to be submitted directly through that provider.

10. Acceptable Use

You agree not to use Arvox to:

• Violate any law, regulation, or third-party right.
• Upload false, misleading, harmful, abusive, defamatory, obscene, discriminatory, or illegal content.
• Harass, threaten, impersonate, exploit, or harm another person.
• Manipulate scores, rankings, leaderboards, competitions, challenges, or performance results.
• Access, collect, or use another user’s information without authorization.
• Attempt to bypass permissions, security controls, authentication, or access restrictions.
• Introduce malware, viruses, harmful code, bots, scraping tools, or automated abuse.
• Reverse engineer, copy, modify, resell, sublicense, or exploit Arvox without authorization.
• Use Arvox in a way that interferes with platform performance, availability, or security.
• Use Arvox for medical, emergency, diagnostic, or clinical decision-making purposes.

11. Community Features, Challenges, and Competitions

Arvox may offer community features such as profiles, leaderboards, challenges, competitions, comments, shared workouts, club pages, teams, rankings, and social activity.

By participating in these features, you understand that some information may be visible to other users, coaches, clubs, participants, or the public, depending on your settings and the feature.

You agree to participate honestly and respectfully. Arvox may remove content, adjust results, restrict participation, or disqualify users where we believe there has been cheating, abuse, unsafe conduct, inaccurate submissions, or violation of competition rules.

12. User Content

You may be able to upload, submit, create, or share content through Arvox, including workout results, comments, profile information, photos, videos, coach notes, training plans, workout descriptions, competition submissions, and other materials (“User Content”).

You retain ownership of your User Content. However, by submitting User Content to Arvox, you grant Arvox a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, process, adapt, publish, transmit, and use your User Content as necessary to operate, improve, promote, and provide Arvox services.

• You own or have the rights needed to submit the User Content.
• Your User Content does not violate any law or third-party rights.
• Your User Content does not contain harmful, illegal, or unauthorized material.

13. Intellectual Property

Arvox and its related software, designs, logos, trademarks, branding, graphics, interfaces, features, content, documentation, and technology are owned by Arvox S.A.S. or its licensors.

Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works based on Arvox or any part of the platform.

14. Feedback and Suggestions

If you provide feedback, suggestions, ideas, feature requests, or recommendations about Arvox, you grant us the right to use them without restriction or compensation.

15. Privacy

Your use of Arvox is also governed by our Privacy Policy, which explains how we collect, use, store, share, and protect personal information.

By using Arvox, you acknowledge that your information will be handled according to our Privacy Policy.

16. Service Availability and Changes

We aim to provide a reliable platform, but Arvox may be modified, suspended, interrupted, restricted, or discontinued at any time. We may update, remove, or change features, plans, integrations, supported devices, or platform availability.

We are not liable for service interruptions, data loss, delays, or unavailability caused by maintenance, third-party services, user devices, internet connectivity, or events outside our reasonable control.

17. Disclaimers

To the maximum extent permitted by law, Arvox is provided “as is” and “as available,” without warranties of any kind. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and uninterrupted operation.

18. Limitation of Liability

To the maximum extent permitted by law, Arvox S.A.S., its directors, officers, employees, contractors, partners, affiliates, and service providers shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.

Our total liability for claims related to Arvox will be limited to the amount you paid to Arvox during the period permitted by applicable law.

19. Indemnification

You agree to defend, indemnify, and hold harmless Arvox S.A.S., its directors, officers, employees, contractors, partners, and affiliates from any claims, damages, liabilities, losses, costs, and expenses arising from your use of Arvox, your User Content, your violation of these Terms, or your violation of any law or third-party right.

20. Suspension and Termination

We may suspend or terminate your access to Arvox at any time if we believe you have violated these Terms, created risk, caused harm, or used Arvox in an unauthorized, fraudulent, abusive, or unsafe manner.

You may stop using Arvox at any time. Certain obligations, including payment obligations, intellectual property terms, disclaimers, limitations of liability, and dispute provisions, may survive termination.

21. Governing Law

These Terms are governed by the laws applicable to Arvox S.A.S. and its operations, without regard to conflict of law principles. Any disputes shall be handled according to applicable law and competent jurisdiction.

22. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the website, app, email, or other appropriate means. Continued use of Arvox after changes become effective means you accept the updated Terms.

23. General Terms

These Terms, together with any applicable policies, plan terms, competition rules, and privacy notices, constitute the agreement between you and Arvox regarding your use of the platform.

If any provision is found unenforceable, the remaining provisions will remain in effect.
